CURTIS, J. Alexander C. McMillan, the then owner of two-fifteenths of a certain trust estate, on June 8, 1929, executed and delivered to the defendant Marshall Nuckolls, his promissory note for $63,000 and interest at 10 per cent per annum, payable semi-annually, and to secure the payment of the same executed a written assignment to said Marshall Nuckolls of said two-fifteenths of said trust estate. On November 21st of the same year, said Alexander C. McMillan executed and delivered to said Marshall Nuckolls, a second promissory note in an amount of $5,000 and interest, and secured the payment of the same by a further assignment of said two-fifteenths of said trust estate.
